Court tosses Donuts’ .Web lawsuit because Donuts promised not to sue

Judge says agreement not to sue is enforceable.

Judge Percy Anderson of the U.S. District Court, Central District of California has granted (pdf) ICANN’s motion to dismiss in a lawsuit brought by a subsidiary of new TLD company Donuts.

Donuts filed a lawsuit because it was upset that Verisign was bankrolling another applicant’s bid for the domain. Donuts believed that the applicant, Nu Dot Co, had undergone changes that required updating information with ICANN prior to the auction.....

If they have premium pricing set, it is just another waste of investment.

If the .web wants to be the next king of domain names, price should be in $10-$15 price range.

Don't be another .blog price scheme and hoarding the best keywords.

Netsol started the premium pricing on .TV and most likely will be the same for .web extension.

The tables are turned: now Donuts can delay Verisign


Waiting for the .Web.

Many curse words were muttered about Verisign during the process of designing the new top level domain name program. Verisign spread plenty of FUD to delay the program.

Now, the biggest new TLD company gets to take a turn at delaying Verisign.

Verisign struck a deal to acquire rights to operate .web from Nu Dot Co prior to a $135 million auction for the top level domain. Donuts, Afilias and other applicants cried foul. Donuts subsequently sued but a judge tossed out the lawsuit. Donuts, however, says it “will continue to utilize the tools at its disposal to address this procedural failure.”
