In the main it just isn't worth it. Sure providing it isn't a blatant infringement you could use it for another topic Non infringing. But there are too many If's and But's that apply to cover in a short reply. You would need to read-up on TM infringement, which is quite complex.

If it's a well known TM then nobody is going to be interested in buying it anyway . There isn't a short yes or No answer as each case is unique. The same applies to the consequences, It would depend on what action was instigated.
