so, what if you reg a name for a movie that's not coming out for like a year and a half? do you get in trouble? or what? enlighten me, please. :)

It would depend on what you use it for. If you reg it for the sole purpose of cybersquatting, you would have no chance defending the name.

Likely scenario would be if the movie studio wanted it enough they could file a dispute to get it back. But there's a chance they wouldn't even pursue it because the dispute process takes several months, or they have no interest in the name.

I'd suggest reading up on the UDRP and past domain disputes.

Also, I see a lot of movies using alternative versions like SomethingTheMovie.com or Something.Sony.com. Its actually odd that they would spend tens (hundreds?) of millions on the actual film, yet skip paying for the obvious domain name.

i would say go for it! there is nothing much to lose except for reg $$ unless you spent a lot of time on development, and then lose the battle!!

read the case you listed RJ. seems to me that the main reason a settlement wasn;t reached was the domain owners pointing the domain towards an anti-abortion site..... that seemed to be of the most offense, more so than the trademark infringement...

so, let's say i made a fan site of this nunnamed upcoming movie. i mean, i would like some traffic and some links on a trafficked page, perhaps i'll do that. in that case, i wouldn't be squatting, right?

I would have to agree, movie studios would most likely not go after a domain for a upcoming movie. But its not certain for sure if they will or not, most of the time they go for the alternative way by adding the suffix movie and etc.

I don't think 99% of them would seek a lawsuit--their too busy with other things and the domain isn't the movie. They would and are more commonly seeking the alternative name:

xxxxxmovie.com or xxxxxthemovie.com

Go for it.

They are naming a movie. You are naming a website. As long as you don't base the website on the movie or if you do base the website on the movie make sure you do it as a non-profit personal expression. Otherwise, they'd have a good case to bring to the WIPO.
